Policy for Review and Resolution of Participant Complaints or Disputes:

OPTION 1:

CEU Outlet strives to ensure customer satisfaction, and we will do our best to resolve any issues or disputes that may arise regarding our Services. If a dispute cannot be resolved informally, both parties agree to participate in a mediation process to try and reach a mutually acceptable resolution. If mediation is unsuccessful or not chosen, then CEU Outlet and the customer agree to resolve the dispute through binding arbitration, instead of litigation in a court of general jurisdiction.

Arbitration is a more informal process that involves a neutral arbitrator instead of a judge or jury. While there are some limits on the discovery process, the parties agree to work together to determine reasonable discovery based on the issues and claims at hand. The arbitrator may award the same damages and relief as a court but will apply the same substantive law regarding damages as if the matter were being brought in court, including any relevant law on punitive damages as applied by the United States Supreme Court.

By agreeing to these Terms of Use, the customer and CEU Outlet agree that the U.S. Federal Arbitration Act governs the interpretation and enforcement of this provision. Both parties are also waiving their right to a trial by jury or to participate in a class action. This arbitration provision will remain in effect even if the customer's contractual relationship with CEU Outlet is terminated.

If a customer wishes to initiate arbitration against CEU Outlet, they must first send a written notice of their claim by certified mail to CEU Outlet's CEO at the following address: CEU Outlet, Attn: CEO, [address], [city], [state], [zip code]. CEU Outlet will send a written Notice to the customer's most recent address on file or in our records. Both Notices must describe the nature and basis of the claim or dispute, and the specific relief sought. If the parties are unable to resolve the dispute within 30 days after the Notice is received, either party may commence an arbitration or file a claim in small claims court.

During the arbitration process, any settlement offers made by CEU Outlet or the customer will not be disclosed to the arbitrator. If the customer is required to pay a filing fee, CEU Outlet will reimburse the fee, unless the claim exceeds US $(amount). The arbitration will be governed by the Commercial Arbitration Rules and the Supplementary Procedures for Consumer-Related Disputes of the American Arbitration Association (AAA), as modified by these Terms of Use. The arbitrator will be bound by these Terms of Use and will decide all issues, including those relating to the scope and enforceability of this arbitration agreement.

Unless otherwise agreed by the parties, all arbitration hearings will take place in [city], [state]. If the claim is for US $(amount) or less, the arbitration may be conducted solely on the basis of documents submitted to the arbitrator, through a telephonic hearing, or by an in-person hearing as established by the AAA Rules. If the claim exceeds US $(amount), the right to a hearing will be determined by the AAA Rules. Regardless of the hearing method, the arbitrator will issue a written decision explaining their decision.

To submit a complaint, please use our Contact Us page, where you can send us an email with the details of your complaint. The emails are sent to [email protected]. If you need to speak with someone live, you may call us at (XXX)XXX-XXXX. This contact information as well as our customer service hours are listed on our Contact Us page.
